Terms and Conditions
These Terms and Conditions govern the sale of goods by The Lighterhouse and the use of its website. They should be read together with our Return Policy, our Disclaimer and our Privacy Policy, each of which forms part of the agreement between us.
1. Identity and contact details
The Lighterhouse is a trade name of M.A.X. Meijster, a sole proprietorship established in the Netherlands.

These details are published in accordance with Article 3:15d of the Burgerlijk Wetboek and Article 6:230m of the Burgerlijk Wetboek.
2. Scope
These Terms apply to every offer made by The Lighterhouse, to every order placed through our website, and to every contract of sale concluded between us. By placing an order you accept these Terms.
Where a provision of these Terms conflicts with a mandatory rule of consumer law, that rule prevails and the remainder of these Terms continues to apply.
Deviations from these Terms are binding only where we have agreed them with you in writing.
3. Definitions
The Lighterhouse, we, us, our: the business identified in section 1.
Consumer: a natural person acting for purposes outside their trade, business, craft or profession.
Business buyer: any other buyer.
Goods: the lighters and related items we offer for sale.
4. The website and your account
You may need an account to use certain features. You agree to provide accurate information, to keep it current, and to keep your login details confidential. You are responsible for activity carried out through your account.
Our website is not directed at persons under 18 years of age.
Certain newly listed goods are shown first, for a limited period, to existing customers holding a higher client status before becoming visible to all visitors.
5. Prices and payment
Prices are stated in euros and include all taxes due. Because we deal in second-hand goods, we apply the Dutch VAT margin scheme. VAT is therefore calculated on our margin, is not shown separately on the invoice, and cannot be reclaimed by a business buyer. For this reason there is no VAT number field at checkout.
Unless stated otherwise on the listing, standard delivery is included in the price. Where you select an upgraded delivery service, the supplement is charged in addition and is shown before you complete the order.
Payment is processed by Mollie B.V. By submitting payment details you confirm that you are authorised to use the payment method concerned.
We take care to price accurately. Where a price is manifestly incorrect we may decline the order and refund any sum paid in full, and we will contact you before doing so.
6. Formation of the contract
Listings on our website are an invitation to treat and not a binding offer. A contract is concluded when we confirm your order by email.
Each lighter we sell is a single item. Goods are not reserved or set aside, and an order is the only means by which an item is secured. Where an item becomes unavailable between your order and our confirmation, we will tell you and refund any sum paid in full.
7. Delivery and risk
Delivery times stated on the website are estimates. We are not liable for delays caused by carriers, customs authorities or other circumstances beyond our control, although we will keep you informed and assist wherever we can.
In accordance with Article 7:11 of the Burgerlijk Wetboek, the risk of loss of or damage to the goods passes to a consumer only once the goods have been received by the consumer or by a carrier designated by the consumer. Every consignment we despatch is tracked and insured.
Goods are despatched containing only a trace of fuel, since carriers do not accept filled lighters.
8. Right of withdrawal
A consumer resident in the European Union may withdraw from the contract within 14 days of receiving the goods, without giving a reason, in accordance with Article 6:230o of the Burgerlijk Wetboek and Directive 2011/83/EU.
The exercise of that right, the condition in which goods must be returned, the treatment of delivery costs, the position of buyers outside the European Union, and the goods excluded from return, are set out in full in our Return Policy, which forms part of these Terms.
In every case you must contact us before returning anything and wait for our instructions. We arrange the return ourselves and issue the label. A return despatched without prior agreement may be declined.
9. Conformity and guarantee
Goods must conform to the contract. Where they do not, a consumer has the remedies provided by Article 7:17 of the Burgerlijk Wetboek and Directive (EU) 2019/771, namely repair, replacement, a proportionate price reduction, or rescission of the contract.
Conformity is assessed against what may reasonably be expected given the age, price, description and second-hand nature of the goods.
In addition to those statutory rights, we provide a guarantee of six months from delivery on the servicing carried out before sale. The scope of that guarantee, what it does not cover, and what may reasonably be expected of a serviced vintage lighter, are set out in our Disclaimer.
Nothing in these Terms limits or excludes a consumer’s statutory rights, and any provision that appears to do so is to be read subject to this section.
10. Complaints
If something is wrong, write to contact@thelighterhouse.com. We ask that you do so within a reasonable period of discovering the problem, and in any event promptly, so that we can address it while the facts are clear.
We will acknowledge a complaint within 14 days and give a substantive response, or an indication of when one will follow, within a reasonable period.
A consumer in the Netherlands may obtain independent information about their rights from ACM ConsuWijzer. Consumers in other Member States may approach the equivalent body in their own country. This does not affect your right to bring proceedings before a competent court.
11. Acceptable use of the website
You may not use our website for any unlawful purpose, transmit malicious code, attempt to gain unauthorised access to our systems, collect the personal data of others without their consent, or act in a way that interferes with the use of the website by others.
You may not extract, scrape or reproduce our listings, photographs or written content for commercial purposes without our prior written consent.
12. Intellectual property
All content published by The Lighterhouse, including photographs, listing descriptions, articles, guides, logos and marketing material, whether on this website or on our social media channels, is our property or is used by us under licence, and is protected by Dutch and European intellectual property law.
Our photographs are taken of the individual items we sell and are not stock images. They may not be reproduced, altered or used in any listing or advertisement without our prior written consent.
Third-party trademarks and brand names appearing on this website are the property of their respective owners and are used solely to identify and describe the goods offered, as permitted under Article 14(1)(c) of Regulation (EU) 2017/1001. We are an independent dealer and are not affiliated with or endorsed by any manufacturer.
13. Liability
Subject to the paragraph below, our liability is limited to direct loss and, in any event, to the invoice value of the goods concerned. We are not liable for indirect or consequential loss, including loss of profit, or for loss arising from delays in carriage, customs clearance or import formalities outside our control.
Nothing in these Terms excludes or limits our liability for death or personal injury, for damage caused intentionally or by gross negligence, for a failure to comply with the conformity obligations referred to in section 9, or for any other liability which may not lawfully be excluded, whether under Article 6:74 of the Burgerlijk Wetboek, the rules on unfair contract terms in Articles 6:231 to 6:247 of the Burgerlijk Wetboek, or otherwise.
14. Force majeure
We are not in default where performance is prevented by circumstances beyond our reasonable control, including carrier disruption, customs action, fire, flood, or the unavailability of a unique item through loss or damage before despatch. Where such circumstances persist, either party may rescind the contract and any sum paid will be refunded in full.
15. Personal data
Personal data provided in connection with an order or an enquiry is processed as described in our Privacy Policy.
16. Amendments
We may amend these Terms. The version in force at the time your order is placed is the version that governs that contract. The current version is published at this address and identified by the date below.
17. Applicable law and competent court
These Terms and every contract concluded under them are governed by Dutch law.
Where you are a consumer habitually resident in another Member State of the European Union, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your own country, in accordance with Article 6(2) of Regulation (EC) No 593/2008 (Rome I).
Disputes will be submitted to the competent court in the Netherlands. Where you are a consumer, this is without prejudice to your right under Regulation (EU) No 1215/2012 to bring proceedings in the courts of your place of domicile, and to be sued only there.
18. Entire agreement
These Terms, together with the Return Policy, the Disclaimer and the Privacy Policy, constitute the entire agreement between us in relation to your order.
